    2. About Intelligence Lens

Intelligence Lens develops and operates digital platforms, learning and credentialing products, AI-assisted tools, application-management services and professional capability-building solutions.

Some Services are used directly by individuals.

Other Services allow independent organisations, institutions, academies, trainers and other providers to manage their own programmes, applications or participants.

    3. Eligibility and Minors

You must be legally capable of agreeing to these Terms or use the Services with the involvement or authorisation of an appropriate parent, guardian or responsible organisation where required.

Where an adult manages an account or profile for:

    • A child

    • A dependant

    • Another individual

that adult confirms that they are authorised to act for that person.

Additional rules may apply to particular Services intended for younger users.

    4. Accounts

Where an account is required, you agree to:

    • Provide accurate information

    • Keep important account information current

    • Protect your login credentials

    • Not share access in an unauthorised manner

    • Notify Intelligence Lens of suspected unauthorised access

    • Use your account lawfully

You are responsible for activity performed through your account unless the activity resulted from circumstances outside your reasonable control.

    Intelligence Lens may require:

    • Email verification

    • Identity verification

    • Organisation verification

    • Additional security checks

    5. Google and Other Sign-In Providers

Where supported, users may sign in through Google or another authentication provider.

Using a third-party authentication provider does not give Intelligence Lens unrestricted access to that user's external account.

Third-party authentication is also subject to the provider's own terms and policies.

PART I: APPLY BY INTELLIGENCE LENS

    6. What Apply Provides

Apply is a technology platform that enables organisations and professionals to create and operate online application and registration processes.

    Clients may create:

    • Programmes

    • Opportunities

    • Application forms

    • Registration processes

    • Document requirements

    • Applicant communications

    • Application workflows

    • Public programme pages

    Applicants may:

    • Create profiles

    • Create dependant or representational profiles

    • Save reusable information

    • Start applications

    • Save drafts

    • Upload documents

    • Submit applications

    • Respond to information requests

    • Receive status updates

    • Manage their Apply account

    7. Apply Is a Platform, Not the Decision Maker

Intelligence Lens provides the technology through which client organisations operate their application processes.

Client organisations remain responsible for their own:

    • Programme information

    • Eligibility criteria

    • Application questions

    • Required documents

    • Deadlines

    • Selection criteria

    • Review processes

    • Admissions

    • Offers

    • Rejections

    • Enrolment

    • Communications

    • Other decisions

Intelligence Lens does not guarantee that:

    • A programme is genuine solely because it appears on Apply

    • An applicant is eligible

    • An application will be considered

    • An applicant will be selected

    • A client will respond within a particular time

    • A programme will proceed as advertised

Intelligence Lens may take reasonable steps to investigate misuse, impersonation or fraudulent portals.

    8. Ownership of Apply Data and Content

    8.1 Applicant Content

Applicants retain their rights in information and documents they create or upload, subject to any rights belonging to third parties.

Intelligence Lens does not acquire ownership of an applicant's application content merely because it is stored through Apply.

By using Apply, the applicant grants Intelligence Lens the limited permission necessary to:

    • Host

    • Store

    • Process

    • Display

    • Transmit

    • Secure

    • Back up

the information as necessary to provide the Service.

    8.2 Client Organisation Content

Client organisations retain their rights in content they create or upload, including:

    • Programme descriptions

    • Forms

    • Questions

    • Branding

    • Brochures

    • Instructions

    • Organisation information

The client grants Intelligence Lens the limited rights necessary to host and operate that content through Apply.

    8.3 Intelligence Lens Platform

The Apply platform itself, including its:

    • Software

    • Architecture

    • Design

    • Workflow

    • Branding

    • Functionality

    • Original templates

    • Platform technology

remains the intellectual property of Intelligence Lens or its licensors.

    9. Reusable Applicant Profiles

Information stored in an applicant's reusable profile is not automatically shared with client organisations.

Applicants control which saved information is used in a particular application.

Client organisations should only receive information submitted to them through the relevant application.

A client organisation is not entitled to access:

    • Applications submitted to other organisations

    • Unsubmitted reusable profile information

    • Private reusable-profile documents not submitted to it

    • Other applicant profiles associated with the same account unless relevant to that client's application

    10. Submitted Application Records

Once an application is submitted, Apply may retain a snapshot of the information provided at the time of submission.

    This record may include:

    • Answers

    • Documents

    • Applicant information

    • Declarations

    • Consent records

    • Submission date

    • Application reference

    • Status history

    • Communications

    • Subsequent approved amendments

A later change to an applicant's reusable profile does not automatically modify an earlier submitted application.

Where a client requests a correction, only the authorised information may be reopened.

The history of changes may be retained for integrity and audit purposes.

    11. Client Rights to Submitted Application Information

By intentionally submitting an application to a client organisation, the applicant authorises that organisation to receive and use the submitted information for legitimate purposes associated with the relevant application, subject to applicable law and the organisation's own obligations.

Submission does not transfer ownership of the applicant's underlying intellectual property to the client organisation.

A client may retain legitimate application records after the applicant closes their Apply account where retention is lawful.

    12. Responsibilities of Apply Clients

A client using Apply agrees to:

    • Provide accurate and non-misleading information

    • Have authority to represent the organisation or opportunity

    • Collect only information reasonably relevant to its purpose

    • Protect applicant confidentiality

    • Use applicant information appropriately

    • Avoid unnecessary collection of sensitive information

    • Keep programme information reasonably current

    • Maintain appropriate access permissions

    • Comply with applicable legal obligations

    • Avoid impersonation

    • Avoid deceptive, fraudulent or misleading activity

Apply must not be used as a phishing or fraudulent data-collection platform.

Intelligence Lens may suspend or remove organisations, programmes or accounts where reasonably necessary to protect users or the platform.

    13. Responsibilities of Applicants

Applicants are responsible for the accuracy and legitimacy of information they submit.

    Applicants must not knowingly submit:

    • Forged documents

    • Fraudulent information

    • Misleading qualifications

    • Information belonging to another person without authority

    • Malicious files

If an account holder submits an application for another person, that account holder confirms that they are authorised to do so.

    14. Files and Documents

    Users must not upload:

    • Malware

    • Viruses

    • Malicious code

    • Illegal material

    • Information obtained unlawfully

    • Material infringing third-party rights

    • Content the user is not authorised to provide

Intelligence Lens may block, quarantine, remove or restrict access to content where reasonably necessary for security, legal or platform-integrity purposes.

PART II: CREDENTIALS, LEARNING AND ALUMNI RECORDS

    15. Intelligence Lens Credentials

    Some Services may issue:

    • Credentials

    • Certificates

    • Digital badges

    • Verification records

    • Assessment results

Issuance may depend on requirements such as:

    • Completion

    • Assessment performance

    • Identity requirements

    • Participation

    • Other programme criteria

A credential represents only what is expressly stated in the credential.

    It does not guarantee:

    • Employment

    • Promotion

    • Admission

    • Professional licensing

    • Commercial success

    • Any other future outcome

    16. Credential Integrity and Non-Deletion

Credentials issued by Intelligence Lens form part of the official integrity and verification record of the relevant credentialing system.

Credential records are not ordinary user-generated profile content.

Closing an account or deleting a user profile does not automatically require Intelligence Lens to erase the existence or verification history of a legitimately issued credential.

Subject to applicable law, Intelligence Lens may retain the minimum record reasonably necessary to:

    • Confirm credential issuance

    • Verify authenticity

    • Prevent fraud

    • Record credential status

    • Maintain historical issuance records

    • Record revocation or invalidation

    • Protect the integrity of the credentialing system

    • Resolve disputes

A user may request removal of unnecessary public profile information where appropriate.

However, a limited credential verification record may remain where lawful and reasonably necessary.

Where applicable law requires deletion or restriction and no valid ground for continued retention exists, Intelligence Lens will respond accordingly.

    17. Revocation and Invalidation of Credentials

Intelligence Lens may withhold, invalidate or revoke a credential where there is reasonable evidence of:

    • Fraud

    • Impersonation

    • Assessment misconduct

    • Manipulation

    • Material misrepresentation

    • Technical abuse

    • Unauthorised assistance

    • A significant breach of programme requirements

Where appropriate, the verification record may show that a credential has been revoked or invalidated rather than deleting evidence that it previously existed.

    18. Alumni and Completed Participant Records

Completion of a programme does not necessarily terminate the relationship between Intelligence Lens and the participant.

Subject to applicable law, Intelligence Lens may retain limited alumni, completion and cohort records for:

    • Credential verification

    • Completion history

    • Programme administration

    • Cohort history

    • Alumni identification

    • Impact reporting

    • Support

    • Fraud prevention

    • Institutional recordkeeping

    Where Intelligence Lens provides:

    • Alumni communities

    • Professional networks

    • Alumni communications

    • Future learning opportunities

participation in optional communications may be subject to user preferences or opt-out choices.

Opting out of alumni communications does not automatically delete legitimate credential, completion or verification records.

AI functionality may rely on third-party technology providers where necessary to generate the requested output.

    23. AI Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded.
